1. Introduction
These Terms and Conditions regulate the booking and contracting of transport services, excursions, adventure activities, and tour packages offered by Nairi Tours. By booking any of our tourist services via email, web form, phone, or WhatsApp chat, you declare that you have read, understood, and accepted the conditions detailed in this document.
2. Bookings and Confirmation
All booking requests will be processed through our authorized sales channels.
- Bookings will be officially confirmed once the client receives a Confirmation Voucher in writing via WhatsApp or email from our team of advisors.
- The prices indicated in our tour catalog are expressed in US Dollars (USD). Transactions may also be made in Peruvian Soles (PEN) at the official exchange rate of the day of the transaction provided by our staff.
- For services listed as "Quote Required" (A Cotizar), rates are variable and will depend on the exact route, number of passengers, vehicle type, and special requirements indicated by the client at the time of the formal estimate.
3. Payment and Invoicing Policies
- To confirm and secure the booking of tourist services, Nairi Tours will coordinate with you the percentage of the initial deposit or full payment (depending on the nature of the requested tour or transfer).
- We accept payments via local bank transfers (accounts in Peru), credit/debit cards online through authorized secure payment gateways, and cash at our offices or previously agreed departure points.
- Any bank fees or financial surcharges for international transfers or gateway usage will be the responsibility of the client.
4. Changes, Cancellations, and Refunds
Our policy seeks to balance the flexibility of the traveler with the reservation of local resources (boats, vehicles, and guides):
- Cancellations by the client:
- Cancellations made more than 72 hours prior to the service: A 100% refund of the amount paid will be granted (minus bank or payment gateway fees).
- Cancellations made between 24 and 72 hours prior: 50% of the total will be retained as operational expenses for preparation and logistics.
- Cancellations made less than 24 hours prior or "No Show" (failure to arrive at the agreed time): No refund will apply, forfeiting 100% of the payment made.
- Changes of date or route: May be requested without penalty up to 48 hours before the start of the tour, subject strictly to the availability of the agency's staff and vehicles.
- Cancellations due to Force Majeure or Weather: Paracas and the southern coast of Peru occasionally experience strong winds ("Paracas winds") or sea conditions that cause the port to be closed by order of the Port Captaincy. In the event of a port closure that prevents the boat tour to the Ballestas Islands, or if other unavoidable adverse weather or natural events occur:
- We will prioritize offering to reschedule the activity to a later hour or available date.
- If rescheduling is not viable for your travel itinerary, we will offer an alternative land tour of equal value (such as the Paracas National Reserve circuit).
- If no land option or rescheduled date is accepted, we will proceed with the refund of the amount paid corresponding to the canceled portion of the activity.
5. Passenger Responsibility and Safety
- Punctuality: Passengers must present themselves at the meeting point or hotel lobby at the exact time indicated on their confirmation voucher. Nairi Tours will have a maximum wait tolerance of 10 minutes for transfers to avoid affecting the schedules of other passengers.
- Health and Physical Fitness: Certain tours (such as dune buggy rides in the Huacachina dunes, paragliding, or mini-buggies) involve a certain level of physical exertion or adrenaline. It is the client's duty to inform us beforehand of any pre-existing medical conditions, pregnancy, back problems, or reduced mobility so we can recommend and adapt experiences safely.
- Guide and Driver Instructions: During the development of the entire activity (such as the mandatory use of life jackets on the yacht or harness seat belts in the sand buggies), the passenger agrees to strictly follow the safety instructions dictated by our captains, drivers, and official guides. Nairi Tours reserves the right to interrupt or deny service to any passenger who displays risky behavior or is in a state of intoxication, without the right to a refund.
6. Limitation of Liability
Nairi Tours acts as a direct operator and also, in certain specific services, as a qualified intermediary for transportation and complementary activities. We take full responsibility for the correct selection and supervision of all our collaborators, vehicles, and guides. However, we are not responsible for loss of luggage, delays caused by traffic or external road congestion, civil strikes, or health incidents that occur outside the direct operational control of the agency.
